These Terms and Conditions ("Terms") govern your use of the website amnayalife.com (the "Website") and the purchase and use of any online courses, services, products, and free or paid programs, including but not limited to the "90-Day International Life After Work: From Fear to Confident English Speaking" practical course, Amnaya Life courses, community memberships, and other related services (collectively, the "Products") offered by Amnaya Life LLC, a Wyoming limited liability company ("Amnaya Life," "we," "us," or "our").
By accessing the Website and/or purchasing or using any of our Products, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you must immediately cease using our Website and Products.
Official Language:
These Terms are written in English. Any translation of these Terms is provided for convenience only. In the event of a conflict or discrepancy between the English version and any translated version, the English version shall prevail.
1. Governing Law and Jurisdiction
These Terms and your use of our Products shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. You irrevocably agree that the state and federal courts located in Wyoming shall have exclusive jurisdiction to resolve any dispute or claim arising out of or in connection with these Terms or your use of our Products. The choice of Wyoming law is exclusive, and no other jurisdiction's laws, including any local laws of your country of residence, shall apply.
2. Eligibility and Account Registration
To purchase or access our Products, you must be at least 18 years of age or the age of majority in your jurisdiction. By purchasing or accessing our Products, you represent and warrant that you meet this eligibility requirement. We reserve the right to terminate your access to our Products if we discover that you are a minor.
To access certain features of our Products, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Payments, Billing, and Refund Policy
3.1. Fees and Payment Authorization
All fees for our Products are in U.S. Dollars unless otherwise stated. You authorize us to charge your selected payment method for all applicable fees. You are responsible for all charges incurred under your account, including applicable taxes, and you agree to pay all such charges in full.
You represent and warrant that you are the authorized user of the payment method used to purchase our Products. If you use a payment method that is not in your name, you represent and warrant that you have the express authorization of the account holder to use it.
3.2. Installment Plans
If you select a three-installment payment plan for any Product, you commit to completing all three payments regardless of whether you subsequently use the course content. You must fulfill all payment obligations and may not cancel mid-way or request chargebacks. Failure to comply constitutes a breach of contract, and Amnaya Life reserves the right to immediately terminate your course access and pursue all legal remedies, including but not limited to collection of unpaid amounts and damages.
Upon purchase, the entire course content and bonus resources are immediately made available to you. There is no "installment-based access" model, and you may not request refunds, terminate payments, or cancel orders on the grounds that "payment has not been completed."
If you fail to make the second or third installment payment, or if you initiate a dispute through your issuing bank, Amnaya Life reserves the right to immediately terminate your course access and pursue all legal remedies for damages. If you need to adjust payment arrangements due to special circumstances, you must proactively contact us at [email protected] before the payment due date. Payment disputes arising without prior communication are not eligible for our refund policy.
We will make reasonable efforts to contact you to resolve any payment issues before suspending your access, but we are not obligated to do so.
3.3. Refund Policy
Amnaya Life is committed to providing high-quality digital learning resources while respecting the rights and interests of every student. To ensure fairness for our platform and other users, we establish the following refund policy, with specific terms for each product offering:
3.3.1. For the "90-Day International Life After Work: From Fear to Confident English Speaking" Course
This course offers a 30-day "satisfaction guarantee mechanism" that applies only to students who have completed substantial learning of the pre-recorded course content and still believe the course did not meet their expected outcomes.
Eligibility Requirements: Students who have fully participated in and completed all course modules and assigned exercises after purchase, but still believe the course failed to achieve expected results, may submit a refund request within the specified time limit. Applications must include:
1.Complete and specific course learning records (including viewing progress, interaction records, etc.)
2.All assigned exercise content
3.Course completion certificate (or system records)
4.Clear and reasonable explanation of dissatisfaction
5.Complete refund application form provided by customer service
Refund requests must be submitted via email to [email protected] within 30 days of purchase with all required documentation. Applications without complete documentation will not be processed.
Processing Timeline: Refunds will be reviewed within 14 business days. Upon approval, refund amounts will be processed within 14 business days, less a 4% bank transaction fee to cover processing costs.
Quality Assurance and Disqualifying Conditions: To ensure the legitimacy and integrity of our refund mechanism, the following circumstances will be considered ineligible for refunds, and Amnaya Life reserves the right to reject such applications:
• Students who complete over 80% of course content within 7 days of purchase and lack continuous interaction records (such as not participating in course platform or designated community discussions, questions, or assignment discussions), or whose exercise content is obviously perfunctory, repetitive, superficial, and fails to meet substantial learning standards.
• Students who never submitted practice assignments or interacted normally on official designated community platforms (such as course-specific groups) during the course period, but concentrated on submitting large amounts of assignments or practice content in a short time when applying for refunds. This will be considered a formalistic act to meet refund conditions, and Amnaya Life reserves the right to determine that they did not substantially participate in learning and directly refuse refunds.
• Viewing records showing extensive use of accelerated playback, skipping chapters, or only briefly fast-forwarding to the end of videos, with total viewing time clearly insufficient to complete normal learning processes.
• Submitted assignment content that does not meet course requirements, is plagiarized, machine-translated, or fails to demonstrate personal learning progress.
• Inability to supplement or provide reasonable and complete learning certification documents within the timeframe required by Amnayalife.
• Students with multiple refund applications, abnormal consumption records, or other circumstances deemed by Amnayalife as abuse of the refund mechanism may have their refund applications rejected and may be permanently disqualified from future course purchases.
Amnayalife will conduct comprehensive reviews based on course platform records, community interaction records, practice assignment content, viewing behavior, and other multiple factors, and reserves full discretionary authority for final judgment of refund eligibility and amount approval.
Based on principles of good faith and experience protection, Amnayalife provides satisfaction guarantees as additional services, not legal obligations.
3.3.2. For Global Voice Club Membership
Global Voice Club operates as a subscription-based service with specific terms governing membership plans, billing, cancellations, and refunds.
A. Subscription Plans and Tiers
Global Voice Club offers memberships for various durations ("Subscription Periods"), including but not limited to Annual (52 weeks), 12-Week, and 4-Week plans. For Annual and 12-Week plans, we may offer two distinct pricing tiers:
•Standard Plan: A standard-priced membership without a money-back guarantee.
•Premium Guarantee Plan: A premium-priced membership that includes a money-back guarantee for a specified period (the "Guarantee Period"), as detailed in Section 3.3.3.
Upon purchase, your membership is activated immediately, granting you full access to all digital content and resources corresponding to your plan.
B. Automatic Renewal
To ensure uninterrupted service, all Global Voice Club subscription plans will automatically renew at the end of each Subscription Period. By purchasing a membership, you authorize us to automatically charge the applicable renewal fees to your selected payment method.
C. Renewal Pricing
•Standard Plans will renew at the same price paid during the initial purchase.
•Premium Guarantee Plans are structured with a higher initial fee that covers the money-back guarantee. Upon automatic renewal, these plans will renew at the corresponding Standard Plan price for the same Subscription Period. The money-back guarantee applies only to the initial purchase term and does not extend to any renewal periods.
D. Cancellation Policy
You may cancel your membership subscription at any time. To avoid being charged for the next Subscription Period, you must cancel your subscription at least three (3) days prior to your scheduled renewal date. You can manage your subscription or request cancellation by emailing us at [email protected].
Upon cancellation, your access to Global Voice Club content and services will continue until the end of your current paid Subscription Period. Fees already paid for the current period are non-refundable, except as expressly provided under our Money-Back Guarantee Policy (Section 3.3.3).
3.3.3. Money-Back Guarantee Policy for Global Voice Club
Our money-back guarantees are offered exclusively for our Premium Guarantee Plans and are subject to the following terms:
A. 14-Day Unconditional Money-Back Guarantee (Annual Premium Plan)
If you purchase the Annual (52-week) Premium Guarantee Plan, you are eligible for a 100% full refund if you request it within 14 calendar days of your initial purchase date. This guarantee is unconditional; you are not required to attend any classes to be eligible for the refund.
B. 14-Day Unconditional Money-Back Guarantee (12-Week Premium Plan)
If you purchase the 12-Week Premium Guarantee Plan, you are eligible for a 100% full refund if you request it within 14 calendar days of your initial purchase date. This guarantee is also unconditional.
C. Plans Not Eligible for a Guarantee
The following plans are not eligible for any refund under any circumstances:
•All Standard Plans (including Annual and 12-Week).
•All 4-Week Membership Plans.
D. How to Request a Refund
To request a refund under an eligible Premium Guarantee Plan, you must:
1.Send an email to [email protected] from the email address associated with your account.
2.Complete our refund request form, which will be provided to you upon your initial request. The form includes feedback questions to help us improve our services.
3.Your refund request must be initiated before the end of your applicable Guarantee Period (14 days).
Refund requests will only be processed upon receipt of a completed refund request form. Incomplete forms or requests submitted after the Guarantee Period has expired will not be eligible for a refund.
E. Refund Processing
Upon approval, your refund will be processed within 7-14 business days. The full amount will be returned to your original method of payment. No processing fees will be deducted.
3.3.4. 7-Day Free Trial Policy
From time to time, we may offer a 7-day free trial for the 4-Week Global Voice Club membership.
A. Trial and Automatic Billing
The trial period begins on the day you sign up. If you do not cancel within the 7-day trial period, you will be automatically charged on the 8th day. This payment activates a 4-Week recurring membership subscription.
B. No Refunds After Trial Period
The charge processed after the 7-day free trial is non-refundable. The trial period serves as your opportunity to evaluate the service risk-free.
C. Recurring Charges and Cancellation
Following the initial charge, your 4-Week membership will automatically renew and be billed every 4 weeks. You may cancel the subscription at any time. Cancellation will prevent all future charges. If you cancel after a payment has been made, your access will continue until the end of the 4-week period you have paid for, at which point your access will be revoked.
3.3.5. Legal Basis and Special Declaration
For Course Products: This course is an online digital content product classified as "digital content not provided through tangible media." According to the Consumer Protection, digital purchases are considered delivered upon access and are legally not subject to the seven-day unconditional refund trial period.
For Subscription Products: This product falls under the category of "digital content not provided through tangible media, once you have paid and activated your membership, it is considered that contract fulfillment has begun, and the seven-day withdrawal right does not apply. No full or proportional refunds are available.
Based on principles of good faith and experience protection, Amnayalife provides satisfaction guarantees as additional services, not legal obligations.
3.3.6. General Refund Policy for Other Products
Due to the digital nature of our Products, which are delivered immediately upon purchase, we generally do not offer refunds except as expressly stated in specific product descriptions or as required by applicable law. Digital products cannot be "returned" in the traditional sense, as access and content have already been provided.
3.3.7. Refund Abuse Prevention
We reserve the right to refuse refunds if we detect abuse of our refund policy, including but not limited to:
• Excessive refund requests from the same customer
• Fraudulent activity or misrepresentation
• Attempts to obtain refunds after substantial use of the product
• Violation of our terms of use or intellectual property rights.
• Refunds are not available under any circumstances once the applicable Guarantee Period (14 days for Annual Premium or 14 days for 12-Week Premium) has expired."
•Any violation of these Terms and Conditions, including but not limited to the intellectual property rights outlined in Section 4, will result in the immediate termination of your account and access to all Products without a refund."
All refund applications must undergo review procedures, and Amnayalife reserves final decision rights. If students disagree with refund decisions, they may communicate further through customer service email but may not demand additional compensation or damages.
All refund decisions are final and at the sole discretion of Amnayalife.
3.3.8. Special Offers, Bundles and Excluded Guarantees
Unless otherwise explicitly stated in writing, any purchase made under a special promotional offer, discount bundle, “early bird” deal or other reduced‑price package (collectively “Special Offers”) is not eligible for any refund, guarantee or trial‑period benefit provided elsewhere in these Terms (including, but not limited to, the satisfaction guarantee under Section 3.3.1 or the 7‑day “peace of mind” guarantee under Section 3.3.3). By purchasing under a Special Offer you acknowledge that you understand and agree that no entitlement to such guarantee or refund will apply to your purchase.
4. Intellectual Property and License to Use
4.1. Ownership
All content included in our Products, including but not limited to text, graphics, logos, images, videos, audio, and software, is the property of Amnaya Life or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. The Amnaya Life name and logo are trademarks of Amnaya Life LLC.
4.2. License to Use
When you purchase a Product, you are granted a limited, non-exclusive, non-transferable license to access and use the Product for your personal, non-commercial use. This license does not grant you any ownership rights in the Product. You may not:
• Resell, reproduce, distribute, or otherwise share the Product with any third party. • Modify, create derivative works of, or otherwise alter the Product. • Remove any copyright, trademark, or other proprietary notices from the Product.
Any unauthorized use of our content may result in the immediate termination of your access to our Products and may subject you to civil and criminal penalties.
5. DMCA Notice and Takedown Procedure
Amnaya Life respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our Website that are reported to our Designated Copyright Agent.
If you are a copyright owner, or are authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the Website by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR PRODUCTS WILL BE UNINTERRUPTED OR ERROR-FREE. WE MAKE NO WARRANTIES AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF OUR PRODUCTS OR AS TO THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION PROVIDED THROUGH OUR PRODUCTS.
6.2. Limitation of Liability
IN NO EVENT SHALL AMNAYA LIFE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR PRODUCTS, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR PRODUCTS, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR PRODUCTS BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

10. Force Majeure

If a Force Majeure Event prevents or delays our performance of any obligation under these Terms for a period of more than thirty (30) consecutive days, either party may terminate the affected services upon written notice to the other party. In such cases, we will provide appropriate remedies as outlined in the specific product terms, including but not limited to subscription pauses, extensions, or pro-rated refunds where applicable.
We will make reasonable efforts to notify you of any Force Majeure Event that may affect our services and will work diligently to resume normal operations as soon as reasonably possible.
11. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that most closely reflects the original intent of the parties.
If the severance of any provision materially affects the fundamental purpose or structure of these Terms, the parties agree to negotiate in good faith to replace the severed provision with a mutually acceptable alternative.
12. Termination
12.1. Termination by Amnaya Life
We reserve the right to terminate or suspend your access to our Products immediately, without prior notice or liability, for any reason whatsoever, including but not limited to:
• Violation of Intellectual Property Rights: Unauthorized use, reproduction, distribution, or sharing of our proprietary content, materials, or intellectual property.
• Abusive Behavior: Harassment, threats, or abusive conduct toward our staff, instructors, or other users, whether through our platforms, email, social media, or any other communication channel.
• Fraudulent Activity: Engaging in fraudulent transactions, providing false information, using unauthorized payment methods, or attempting to circumvent our payment systems.
• Breach of Terms: Violation of any provision of these Terms and Conditions or our Privacy Policy.
• Illegal Activity: Using our Products for any illegal purpose or in violation of any applicable laws or regulations.
• Disruptive Behavior: Conduct that disrupts the learning environment, interferes with other users' experience, or damages the integrity of our educational community.
12.2. Effect of Termination
Upon termination: • Your access to all Products will be immediately revoked • You will forfeit any unused portion of paid services without refund, except as specifically provided in these Terms • All licenses granted to you under these Terms will immediately cease • You must cease all use of our intellectual property and delete any downloaded materials.
12.3. Survival
The following provisions shall survive termination of these Terms: intellectual property rights, limitation of liability, indemnification obligations, governing law, and any payment obligations incurred prior to termination.
13. Third-Party Platform Dependency (Global Voice Club)
13.1. Third-Party Service Provider
Global Voice Club utilizes a third-party software platform, to deliver live online classes and interactive learning experiences. Our ability to provide certain Global Voice Club services depends on the availability and functionality of this third-party platform.
13.2. Platform Interruptions and Service Adjustments
In the event that the third party platform experiences technical difficulties, outages, or becomes unavailable for any reason:
Immediate Response: We will pause all active Global Voice Club subscriptions during the period when the platform is unavailable. No subscription time will be counted during platform downtime, and your subscription period will be automatically extended to account for the interruption.
Communication: We will notify affected members via email and our website about any significant platform issues and provide regular updates on the status of service restoration efforts.
Extended Outages: If the third party platform remains unavailable for more than thirty (30) consecutive days, we will offer affected Global Voice Club members the following options:
1.Continued Subscription: Wait for platform restoration with subscription remaining paused (no time counted against your subscription period).
2.Partial Refund: Receive a pro-rated refund based on the remaining subscription time in your current billing cycle, calculated from the date you choose this option. The refund will exclude any time during which the platform was unavailable and your subscription was paused.
Refund Calculation Example: If you have a 3-month subscription with 60 days remaining when you choose the partial refund option, and the platform was down for 20 days (during which your subscription was paused), your refund would be calculated based on the 60 remaining days of active subscription time.
13.3. Alternative Service Delivery
During platform outages, we may, at our discretion, attempt to provide alternative learning opportunities such as: • Recorded session access • Alternative platform solutions • Extended community support • Additional resources or materials
However, we are not obligated to provide such alternatives, and they may not fully replicate the live interactive experience.
13.4. Limitation of Liability for Third-Party Services
While we will make reasonable efforts to ensure service continuity, we are not liable for any damages, losses, or inconvenience caused by third-party platform failures, outages, or discontinuation of services. Our liability is limited to the remedies specifically outlined in this section.
13.5. Platform Changes
If the third party platform discontinues its services permanently or we decide to change to a different platform provider, we will provide at least thirty (30) days' notice to Global Voice Club members and will offer appropriate transition options, which may include service migration, subscription transfers, or pro-rated refunds.

欲使用本公司產品之特定功能,您可能需建立帳戶。您同意於註冊過程中提供準確、最新且完整之資訊,並於必要時更新該等資訊以維持其準確、最新及完整。您應妥善保管您的密碼,並對所有經由您的帳戶所發生之行為負責。您同意若發現帳戶有任何未經授權之使用,應立即通知本公司。
3. 付款、帳單及退款政策 (Payments, Billing, and Refund Policy)
3.1. 費用及付款授權
除非另有說明,本公司產品之所有費用均以美金(U.S. Dollars)計價。您授權本公司向您所選擇之付款方式收取所有適用費用。您應負責支付您帳戶下所產生之所有費用,包括適用稅款,並同意全額支付該等費用。
您聲明並保證,您為用於購買本公司產品之付款方式的授權使用人。若您使用非本人名義之付款方式,您聲明並保證已取得該帳戶持有人明確授權使用該付款方式。
3.2. 分期付款計畫
若您選擇任何產品之三期付款方案,即表示您承諾完成全部三期付款,無論您是否後續使用課程內容。您必須履行所有付款義務,且不得中途取消或要求退款。未遵守者構成違約,Amnaya Life保留立即終止您課程使用權並採取一切法律救濟措施之權利,包括但不限於追討未付款項及損害賠償。
購買後,整套課程內容及贈品資源將立即提供予您。課程並無「分期付款分階段開放」之模式,且您不得以「付款未完成」為由要求退款、終止付款或取消訂單。
若您未能支付第二期或第三期款項,或透過發卡銀行發起爭議,Amnaya Life保留立即終止您課程使用權並追究損害賠償之所有法律救濟權利。若因特殊情況需調整付款安排,您必須於付款到期日前主動聯繫我們,電子郵件地址為 [email protected]。未經事先溝通而產生之付款爭議,將不適用本退款政策。
我們將合理努力聯繫您以解決任何付款問題,惟無義務於終止您使用權前進行聯繫。
3.3. 退款政策 (Refund Policy)
Amnaya Life 致力於提供高品質的數位學習資源,同時尊重每位學生的權利與利益。為確保本平台及其他使用者之公平性,特訂定以下退款政策,並針對各產品提供具體條款:
3.3.1. 「90-Day International Life After Work: From Fear to Confident English Speaking」課程
本課程提供30天「滿意保證機制」(satisfaction guarantee mechanism),僅適用於已完成全部預錄課程內容及指定作業練習,且仍認為課程未達預期效果之學生。
資格條件:購課後已完整參與並完成所有課程模組及指定練習,仍認為課程未達預期成效者,得於指定期限內提出退款申請。申請時須附具:
1. 完整且具體之課程學習紀錄(包括觀看進度、互動紀錄等)
2. 所有指定練習內容
3. 課程完成證書(或系統紀錄)
4. 不滿意之明確且合理說明
5.填寫由客服提供之完整退款申請表格
退款申請必須於購買日起30日內,透過電子郵件寄至[email protected],並附上所有必要文件。未附完整文件之申請將不予受理。
處理時程:退款申請將於14個營業日內審核。經核准後,退款金額將於14個營業日內處理,並扣除4%銀行交易手續費以支付處理成本。
品質保證及不符合退款資格之情形:為確保退款機制之合法性及完整性,以下情形將被視為不符合退款資格,Amnaya Life保留拒絕該等申請之權利:
• 學員於購買後7日內完成超過80%課程內容,且缺乏持續上課互動紀錄(例如未參與課程平台或指定作業繳交、提問或作業討論),或其練習內容明顯敷衍、重複、膚淺,未達實質學習標準。
• 學員於課程期間從未提交練習作業或正常互動於官方指定課程平台(如學員專屬群組),但於申請退款時短時間內集中提交大量作業或練習內容,該行為將視為形式主義以符合退款條件,Amnaya Life保留判定其未實質參與學習並直接拒絕退款之權利。
• 觀看紀錄顯示大量使用加速播放、跳章或僅短暫快轉至影片結尾,總觀看時間明顯不足以完成正常學習程序。
• 提交之作業內容不符課程要求、抄襲、機器翻譯,或未能展現個人學習進度。
• 未能於Amnaya Life要求之期限內補充或提供合理且完整之學習證明文件。
• 學員有多次退款申請、異常消費紀錄或其他Amnaya Life認定為濫用退款機制之情形,將可能遭拒絕退款申請,並永久取消未來課程購買資格。
Amnaya Life將依據課程平台紀錄、社群互動紀錄、練習作業內容、觀看行為及其他多項因素進行綜合審核,並保留退款資格及金額核准之最終裁量權。
基於誠信原則及保障學習權益,Amnaya Life提供滿意保證作為附加服務,非法律義務。
3.3.2. Global Voice Club 會員資格
Global Voice Club以訂閱制服務方式運作,並訂有特定條款規範會員方案、帳單、取消及退款事宜。
A. 訂閱方案與等級
Global Voice Club 提供不同期限之會員方案(以下稱「訂閱期間」),包括但不限於年度(52週)、12週及4週方案。對於年度及12週方案,我們可能提供兩種不同價格等級:
• 標準方案(Standard Plan):標準價格會員方案,無退款保證。
• 尊榮保證方案(Premium Guarantee Plan):較高價格會員方案,包含特定期間內之退款保證(以下稱「保證期間」),詳見第3.3.3條款。
購買後,您的會員資格將立即啟用,並可完整使用與所選方案相符之所有數位內容及資源。
B. 自動續訂
為確保服務不中斷,所有Global Voice Club訂閱方案將於每個訂閱期間結束時自動續訂。購買會員資格即表示您授權我們自動向您所選付款方式收取相應續訂費用。
C. 續訂價格
• 標準方案將以初次購買時相同價格續訂。
• 尊榮保證方案因包含退款保證,初次費用較高。自動續訂時,該方案將以相同訂閱期間之標準方案價格續訂。退款保證僅適用於初次購買期間,續訂期間不適用。
D. 取消政策
您可隨時取消會員訂閱。為避免被收取下一訂閱期間費用,您必須於預定續訂日前至少三(3)天取消訂閱。您可透過電子郵件 [email protected] 管理訂閱或申請取消。
取消後,您仍可使用Global Voice Club及服務至當前已付訂閱期間結束。當期已付費用不予退還,惟依據本公司退款保證政策(第3.3.3條款)另有明文規定者,不在此限。
3.3.3. Global Voice Club 退款保證政策 (Money-Back Guarantee Policy for Global Voice Club)
我們的退款保證僅適用於我們的高級保證方案(Premium Guarantee Plans),並受以下條款約束:
A. 14天無條件退款保證(年度高級方案)
若您購買年度(52週)高級保證方案,於初次購買日起14個日曆日內提出申請,即有資格獲得100%全額退款。此保證為無條件保證,您無需參加任何課程即可符合退款資格。
B. 14天無條件退款保證(12週高級方案)
若您購買12週高級保證方案,於初次購買日起14個日曆日內提出申請,即有資格獲得100%全額退款。此保證亦為無條件保證。
C. 不適用退款保證之方案
以下方案在任何情況下均不適用任何退款:
• 所有標準方案(包括年度及12週方案)。
• 所有4週會員方案。
D. 退款申請方式
欲依符合資格之高級保證方案申請退款,您必須:
1. 由與您帳戶相關聯之電子郵件地址,發送電子郵件至 [email protected]。
2. 請填寫我們的退款申請表,該表格將於您首次提出申請時提供。該表格包含反饋問題,以協助我們改進服務。
3. 您的退款申請必須於適用的保證期間(14天)結束前提出。
退款申請僅在收到完整填寫的退款申請表後方予以處理。未填寫完整之表格或於保證期間屆滿後提出之申請,將不符合退款資格。
E. 退款處理
經核准後,您的退款將於7至14個工作天內處理完成。全額款項將退還至您原始付款方式,且不會扣除任何手續費。
3.3.4. 7天免費試用政策
不時地,我們可能會提供Global Voice Club 4 週會員資格之 7 天免費試用。
A. 試用期與自動扣款
試用期自您註冊當日開始。若您未於 7 天試用期內取消,系統將於第 8 天自動扣款。此筆付款即啟動 4 週循環會員訂閱。
B. 試用期後不予退款
7 天免費試用期結束後所扣款項恕不退還。試用期係供您無風險評估本服務之機會。
C. 循環扣款與取消
首次扣款後,您的 4 週會員資格將自動續約,並每 4 週扣款一次。您可隨時取消訂閱。取消後將停止所有未來扣款。若您於付款後取消,您仍可使用至您已付費之 4 週期限屆滿,屆時將終止您的使用權限。
3.3.5. 法律依據及特別聲明
針對課程產品:本課程為線上數位內容產品,歸類為「非透過有形媒介提供之數位內容」。數位商品於消費者取得存取權時即視為交付完成,不適用無條件退款。
針對訂閱產品:本產品屬於「非透過有形媒介提供之數位內容」類別,消費者於付款並啟動會員資格後,即視為契約履行開始,且不提供全額或比例退款。
基於誠信原則及保障消費者權益,Amnaya Life 提供滿意保證作為額外服務,非法律義務。
3.3.6. 其他產品一般退款政策
由於本公司產品具有數位性質,且於購買後即時交付,除非特定產品說明明確規定或適用法律另有要求,否則本公司一般不提供退款。數位產品無法以傳統方式「退貨」,因為使用權及內容已經提供。
3.3.7. 退款濫用防範 (Refund Abuse Prevention)
我們保留拒絕退款之權利,若發現濫用退款政策,包括但不限於:
• 同一客戶過度申請退款
• 欺詐行為或虛假陳述
• 在產品已大量使用後仍試圖申請退款
• 違反我們的使用條款或智慧財產權
• 一旦適用之保證期間(年度高級版為14天,12週高級版為14天)屆滿,恕不接受任何退款申請。
• 任何違反本條款與細則 (Terms and Conditions) 之行為,包括但不限於第4條所述之智慧財產權,將導致您的帳戶及所有產品使用權立即終止,且不予退款。
所有退款申請皆須經審核程序,Amnaya Life保留最終決定權。若學員對退款決定有異議,得透過客服電子郵件進行進一步溝通,但不得要求額外賠償或損害賠償。
所有退款決定為最終決定,且由Amnaya Life全權酌情決定。
3.3.8. 特別優惠、組合方案及不適用保證事項
除非另有明確書面說明,任何依特殊促銷優惠、折扣組合、「早鳥」方案或其他降價套裝(統稱「特殊優惠」)所進行之購買,均不適用於本條款與細則 (Terms and Conditions) 其他部分所提供之任何退款、保證或試用期利益(包括但不限於第3.3.1條款所述之滿意保證或第3.3.3條款所述之7天「安心保證」)。您於特殊優惠下購買,即表示您已理解並同意該購買不享有上述保證或退款之權利。
4. 智慧財產權與使用授權 (Intellectual Property and License to Use)
4.1. 所有權
本公司產品中包含的所有內容,包括但不限於文字、圖形、標誌、影像、影片、音訊及軟體,均為Amnaya Life或其內容供應商之財產,並受美國及國際著作權、商標及其他智慧財產權法律之保護。Amnaya Life名稱及標誌為Amnaya Life LLC之商標。
4.2. 使用授權
當您購買產品時,您將獲得一項有限的、非專屬的、不可轉讓的授權,得以為個人非商業用途存取及使用該產品。此授權不賦予您對該產品之任何所有權。您不得:
• 轉售、複製、散布或以其他方式與任何第三方分享該產品。

若不可抗力事件導致我們履行本條款與細則 (Terms and Conditions) 下任何義務延遲超過三十(30)連續日,任一方得以書面通知他方終止受影響之服務。在此情況下,我們將依據特定產品條款提供適當補救措施,包括但不限於訂閱暫停、延長或按比例退款(如適用)。

11. 可分割性 (Severability)
若本條款與細則 (Terms and Conditions) 任何條文經有管轄權之法院認定為無效、非法或無法強制執行,該條文應視為自本條款與細則中分離,剩餘條文仍應完全有效。該無效、非法或無法強制執行之條文,應由一有效、合法且可強制執行之條文替代,且該替代條文應最接近雙方原始意圖。

12.1. Amnaya Life 終止權利
Amnaya Life 保留立即終止或暫停您使用本產品之權利,且無需事先通知或承擔任何責任,理由包括但不限於:
• 智慧財產權侵害:未經授權使用、複製、散布或分享本公司專有內容、資料或智慧財產權。
• 濫用行為:對本公司員工、講師或其他使用者進行騷擾、威脅或辱罵,不論透過本平台、電子郵件、社群媒體或其他任何通訊管道。
• 詐欺行為:從事詐欺交易、提供虛假資訊、使用未授權付款方式或試圖規避本公司付款系統。
• 違反條款:違反本條款與細則或隱私權政策之任何規定。
• 非法行為:將本產品用於任何非法目的或違反適用法律法規。
• 妨礙行為:干擾學習環境、妨礙其他使用者體驗或損害本教育社群之完整性之行為。
12.2. 終止之效力
終止時:
• 您對所有產品之存取權將立即被撤銷
• 您將喪失任何未使用之付費服務部分,且不予退款,惟本條款另有明文規定者不在此限
• 本條款授予您的所有授權將立即終止
• 您必須停止使用本公司智慧財產權,並刪除所有下載之資料。
12.3. 條款存續
以下條款於本條款終止後仍繼續有效:智慧財產權、責任限制、賠償義務、準據法及終止前所產生之付款義務。
13. 第三方平台依賴(全球語音俱樂部 (Global Voice Club))
13.1. 第三方服務提供者
Global Voice Club 採用之第三方軟體平台,提供線上直播課程及互動學習體驗。本公司提供部分全球語音俱樂部服務之能力,依賴該第三方平台之可用性及功能。
13.2. 平台中斷及服務調整
若第三方軟體 平台發生技術故障、停機或因任何原因無法使用:
即時回應:平台無法使用期間,我們將暫停所有全球語音俱樂部訂閱。停機期間不計入訂閱時間,您的訂閱期限將自動延長以補償中斷時間。
通知:我們將透過電子郵件及官網通知受影響會員重大平台問題,並定期更新服務恢復狀況。
長期停機:若 第三方軟體平台連續停機超過三十(30)日,受影響會員可選擇:
1. 繼續訂閱:等待平台恢復,訂閱期間持續暫停(不計入訂閱期限)。
2. 部分退款:依當前計費週期剩餘訂閱時間按比例退款,自您選擇此選項之日起計算。退款不包含平台無法使用且訂閱暫停期間。
退款計算範例:若您擁有三個月訂閱,選擇部分退款時尚有60天剩餘,且平台停機20天(訂閱暫停期間),退款將依60天有效訂閱時間計算。
13.3. 替代服務提供
平台停機期間,我們得自行決定嘗試提供替代學習方案,例如:
• 錄製課程存取
• 替代平台方案
• 延長社群支援
• 額外資源或教材
惟我們無義務提供上述替代方案,且該等方案可能無法完全複製直播互動體驗。
13.4. 第三方服務責任限制
雖然我們將合理努力確保服務連續性,對於第三方平台故障、停機或服務終止所致之任何損害、損失或不便,我們不負任何責任。本公司責任僅限於本條款所明訂之補救措施。
13.5. 平台變更
若第三方軟體永久終止服務或本公司決定更換平台供應商,將至少提前三十(30)日通知全球語音俱樂部會員,並提供適當過渡方案,可能包括服務遷移、訂閱轉移或按比例退款。
